Zapis na sąd polubowny zalecany jest w wypadkach, gdy strony nie chcą oddać ewentualnego sporu wynikającego z umowy w ręce sądów państwowych. Może to oznaczać znacznie krótsze terminy rozpatrzenia sporu oraz o wiele niższą cenę rozstrzygnięcia. Niekiedy odpowiednie dobranie sędziów przynosi również bardziej kompetentne rozstrzygnięcie.

Alle Streitigkeiten, die sich im Zusammenhang mit diesem Vertrag oder über seine Gültigkeit ergeben, werden nach der Schiedsgerichtsordnung der Deutschen Institution für Schiedsgerichtsbarkeit e. V. (DIS) unter Ausschluss des ordentlichen Rechtsweges endgültig entschieden. Der Ort des schiedsrichterlichen Verfahrens ist Berlin. Die Anzahl der Schiedsrichter beträgt drei, von denen jeweils ein Richter durch jede Partei genannt wird. Ein Schiedsrichter wird einvernehmlich durch die von den Parteien genannten Richter benannt. Es ist das deutsche materielle Recht anzuwenden. Die Sprache des schiedsrichterlichen Verfahrens ist Deutsch.

All disputes between the Parties arising in connection with this contract or its validity shall be finally settled according to the Arbitration Rules of the German Institution of Arbitration e.V. (DIS) without recourse to the ordinary courts of law. The arbitration proceedings shall take place in Berlin by three arbitrators appointed one by each Party and the third in accordance with the said Rules. Any decision rendered by the arbitrators, pursuant to any arbitration, shall be final and binding upon the Parties hereto, and judgment may be entered upon it in accordance with applicable law in any court of competent jurisdiction.
